Last updated: 27 September 2026
Agreement to these terms
These Terms of Use (“Terms”) govern your access to and use of the McKellar Institute website at mckellarinstitute.com (the “Site”), operated by McKellar Institute Pty Ltd (ABN 45 695 222 121) (“McKellar Institute”, “we”, “us” or “our”). By browsing the Site, creating an account, or submitting a certification application through it, you agree to be bound by these Terms. If you do not agree, please don’t use the Site.

Using the Site
You may use the Site to learn about our certification pathways, submit an application, manage your account, and communicate with us. You agree to use the Site only for lawful purposes and not to:
- attempt to gain unauthorised access to any account, system or data on the Site;
- interfere with or disrupt the Site, its servers, or its security features;
- scrape, harvest or systematically extract content from the Site other than through normal browsing or the interfaces we provide;
- upload or transmit anything unlawful, harmful, fraudulent, or that infringes another person’s rights;
- misrepresent your identity, qualifications or eligibility when applying for a certification.
We may suspend or terminate access to the Site for anyone who breaches these Terms.
Accounts
Some parts of the Site — including submitting and tracking a certification application — require an account. You’re responsible for keeping your sign-in details secure and for all activity under your account. Let us know immediately at hello@mckellarinstitute.com if you suspect unauthorised use.
The information you provide when creating an account or applying for certification must be accurate and kept up to date. Providing false or misleading information may result in your application being refused or your enrolment being cancelled.
Certification applications and enrolment
Applying for a McKellar Institute certification is a separate step from simply browsing the Site, and is governed by its own, separate Application, Enrolment and Certification Terms & Conditions — not by these Terms of Use alone. Those terms are presented to you, and you must review and accept them, at the time you apply. They cover matters specific to your application and enrolment, including fees, refunds, and the nature of the certification, and take precedence over these Terms of Use on any matter they specifically address. These Terms of Use continue to apply to your use of the Site generally, and, together with our Privacy Policy, both sets of terms govern your relationship with us.
Eligibility approval is not the same as enrolment. Your place is only confirmed once payment has been received in accordance with the terms presented during the application process.
Nature of our certifications
McKellar Institute is not a Registered Training Organisation (RTO), is not regulated by the Australian Skills Quality Authority (ASQA) or any equivalent body, and does not claim to be. Our certifications are professional credentials awarded directly by McKellar Institute, assessed against our own standards.
They are not, and are not represented to be, qualifications, units of competency, or any other credential recognised under the Australian Qualifications Framework (AQF), or under any other national or international qualifications framework, and no such accreditation or equivalence is claimed or implied. Completing a McKellar Institute certification does not, by itself, confer any status, licence, or entitlement under a qualifications or professional-registration framework outside McKellar Institute.
The “Talk to McKellar” assistant
Where available, the Site offers an AI-based assistant (“Talk to McKellar”) that can answer questions and help you complete parts of an application by chat or voice. The assistant is a tool to help you — it does not replace, and its responses do not constitute, an official decision, offer, or confirmation from McKellar Institute. Where the assistant helps you complete an application, the information it records is treated the same as information you submit directly through the Site’s forms, and is handled as described in our Privacy Policy.
Intellectual property
The Site, and its content — including text, graphics, logos, course and certification materials, and the McKellar Institute name and marks — is owned by or licensed to McKellar Institute Pty Ltd and is protected by copyright, trade mark and other laws. You may view and download Site content for your own personal, non-commercial use. You may not reproduce, distribute, modify, or create derivative works from Site content, or use our name or marks, without our prior written permission.
Certification materials made available to enrolled learners are for that learner’s own study and assessment use, and may not be shared, resold, or redistributed.
No professional advice
Content on the Site — including course materials, articles and insights — is provided for general and educational purposes. It is not medical, legal, financial or other professional advice, and shouldn’t be relied on as such. You remain responsible for decisions made in your own professional practice.
Availability and changes
We aim to keep the Site available and accurate, but we don’t guarantee that it will always be available, uninterrupted, or error-free. We may change, suspend or discontinue any part of the Site, including features such as the AI assistant, at any time.
Liability
To the maximum extent permitted by law, McKellar Institute Pty Ltd excludes all warranties and conditions relating to the Site and its content, and is not liable for any indirect, incidental or consequential loss arising from your use of the Site. Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, including under the Australian Consumer Law.
Third-party links
The Site may link to third-party websites or services we don’t control. We’re not responsible for their content or practices — we’d suggest reviewing their own terms and privacy policies before using them.
Governing law
These Terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of its courts.
Changes to these Terms
We may update these Terms from time to time, for example as the Site or our services change. The version in effect is the one published here, with its “last updated” date above. Continuing to use the Site after an update means you accept the revised Terms.
